Indemnification
I agree and acknowledge that I am under no pressure or duress to sign this agreement and that I have been given a reasonable opportunity to review it before signing. I am free to have my own legal counsel review this agreement if I choose.
Each party agrees to indemnify the other party and the other party's employees, officers, directors, agents, family members, and related parties against damages for bodily injury, including death, or damage to real or tangible personal property to the extent proximately caused while performing this agreement.
I intend to bind myself, my heirs, agents, relatives, executors, administrators, assigns, and successors in interest. I release and discharge Sober Living Riches, its agents, owners, landlords, directors, executives, successors, administrators, assigns, and affiliates from claims created by or arising from the service or housing space provided. I waive claims for damage to persons or property resulting from use of the premises, including claims arising from negligent acts or omissions to the extent permitted by law.
I and anyone acting on my behalf agree to indemnify and hold harmless Sober Living Riches, its owners, representatives, agents, officers, directors, employees, and the property owner from claims or damages involving me, my child, invitee, or guest.
This agreement includes injuries involving wet or dry surfaces, transportation, fire, sprains, broken limbs, cuts, abrasions, eye injuries, bacterial infections, death, fights, drowning, riots, stabbings, severe weather, terrorism, other acts of God, and accidents or injuries on or off the property.
I assume the risks associated with pools, trampolines, or recreational facilities on property managed by Sober Living Riches and waive claims arising from use of those facilities or participation in activities to the extent permitted by law.
Each party agrees to indemnify and hold harmless the other party and its employees, members, landlord, successors, attorneys, family members, agents, and assigns from claims, liabilities, losses, damages, and expenses arising from the indemnifying party's negligence, willful misconduct, or failure to perform obligations under this agreement. This provision benefits only the parties to this agreement.
I will indemnify and hold harmless Sober Living Riches, its agents, owners, directors, and officers against liability caused by my acts or omissions or those of my family, guests, agents, or employees. I will also hold the property owner harmless from liability, damage, or expense for which this agreement required me to obtain insurance and I failed to do so.
Sober Living Riches, its agents, owners, directors, and officers are not liable for damage or loss caused by other residents or other persons, theft, vandalism, fire, water, smoke, explosions, or other causes unless the loss arises solely from their omission, fault, negligence, or misconduct. Delay in enforcing another resident's obligations is not negligence, omission, fault, or misconduct.
I acknowledge that security cameras may be used to protect the premises from theft, unauthorized access, or property damage. Cameras may record video and audio and will be positioned to respect resident privacy. I accept monitoring of common interior and exterior spaces and agree not to tamper with security equipment.
